Tutor Agreement

This Tutor Agreement (the "Agreement") sets forth the terms and conditions between DocExams.com (the ‘Site’) and you, an independent tutor. By using site tutoring services, you agree to be legally bound by these terms and conditions (the “Terms”), which shall take effect immediately on your first use of site.

As a Tutor, You represent, warrant, and covenant that:
  1. You will visit the Site personally and fill out registration form completely by yourself as required. All provided information must be accurate which should be in no way misleading. Tutor must update this information to maintain its accuracy.
  2. You must comply with code of conduct of the site.
  3. You agree to abide by the site payment cycle and cash out options.
  4. You, being a tutor are not employee of the Site but rather have relation of contract with the Site. Therefore, you are solely responsible for your own actions both on and off the site.
  5. You will be responsible for all of your Submitted material/content. Any such material/content shall not infringe or misappropriate any intellectual property right of a third party. You agree that you own or have the necessary licenses, rights, consents, and permissions, and the authority to authorize the Site, to reproduce, distribute, publicly perform (including by means of a digital audio transmission), publicly display, communicate to the public, promote, market and otherwise use and exploit any of your submitted content on and through the services in the manner contemplated by this tutor agreement.
  6. You must have required qualifications, credentials and expertise, including without limitation, education, training, knowledge, and skill sets, to teach and offer the services you offer on your published/offered course at the Site.
  7. You must respond with a tutoring proposal as soon as possible to the relevant connect request message sent by student/site. You must use your own judgment before committing to student by sending tutoring proposal.
  8. You must ensure your availability during the course for decided days and timings. No changes can be made to days and timing afterwards unless agreed by both student(s) and the Site.
  9. You must fulfill the commitments made with student in sent tutoring proposal. If failed to deliver commitments, tutor will be liable to repay any payments received or payments will be deducted from he decided total fee by the site.
  10. You must complete decided course on time using site virtual classroom platform only.
  11. You acknowledge and agree the right for student to claim refund against your offered course/tuition. Any such claim will be thoroughly verified by the Site. Any refund amount will be deducted from the accumulated amount to be paid to the tutor.
  12. You can set his/her per hour fee but the set amount must not be irrational or beyond his/her level of expertise. Additionally, you agree to not charge separately for any course add-ons such as downloadable PDFs/MCQs or other content and services (such as providing a link to a third party service to sell MCQs etc). The Site will handle billing and other fee interaction with Students.
  13. Tutor must acknowledge that his ranking will be based upon certain factors, like,
    1. Qualification and expertise
    2. Students’ feedback on the lessons/courses taught.
    3. Prompt response on students’ connect request.
    These ranking factors will contribute to tutors being rank higher on our tutor search result page.
  14. You agree and acknowledge that all Online Lessons you deliver will be recorded and stored by the SITE. Any such recording will only be used in advertising or public with express permission from both the tutor and the student in the video.
  15. You will not interfere with or otherwise prevent other tutors from providing their services or courses.
  16. You will not use the Site for any business other than for providing tutoring/teaching and instructional services to students.
  17. You will not engage in activity that may require the Site to obtain any license from any third party.
  18. You will not upload or post any unsolicited, unauthorized, offensive or misleading advertising/material OR virus, worm and spyware that may be intended to damage or hijack any hardware or software through the Site or to any user/student.
  19. You will not impersonate another person or gain unauthorized access to another person's account;
  20. You should make no attempts to solicit Students or disintermediate site in any way, either at the time of booking or at any point in future.
  21. You must disclose any criminal conviction or any such record (if any) to this site.
  22. You must seek tuition consent from parent or guardian in the beginning of course if student age is under 18.
  23. You must not disclose any personal contact detail (Email, Contact number, Address) during profile creation or after approval of profile to go live, if we found at any stage we have right to block tutor with the immediate effect.
  24. Your registration and use of the Site’s services are subject to the Site's approval, which may be granted or denied by the Site in its sole discretion without giving any explanation whatsoever.
Any tutor who fails to meet this agreement may be immediately blocked from using the site and related services. We reserve the right to cancel any existing bookings/payments, at any time.
